Terms of Service

Last updated 23 September 2026

These terms cover two things: using this website, and the design and development work we carry out for clients. Where a signed proposal or contract says something different, that document wins.

1. Using this website

The content of this site — copy, design, code, imagery and the film — belongs to OBSCVRA. You are welcome to view and share it. You may not copy, resell or republish it as your own work.

The projects shown in our work section are clearly labelled concept projects. They were created to demonstrate our craft across industries and are not live client engagements. The brands named in them are fictional.

2. Quotes and scope

Prices listed on this site are starting prices for the scope described in each package. After a discovery call we confirm the scope and send a fixed-price proposal, which is valid for 30 days. Work that falls outside the agreed scope is quoted separately before it starts.

3. Payment

Unless the proposal says otherwise, 50% of the project fee is payable before work begins and the balance on completion, before the site goes live. Monthly Care and Growth plans are billed in advance and can be cancelled with 30 days' notice. Invoices are in US dollars, and any taxes, bank charges or currency conversion costs are payable by the client.

4. What we need from you

Projects run on a schedule that assumes timely input. You agree to provide content, brand assets, access to accounts and feedback within the windows set out in the proposal. Where a delay comes from your side, delivery dates move accordingly. Anything you supply must be yours to use — we rely on that.

5. Revisions

Each package includes a set number of revision rounds: Orbit includes 1, Nova 2, and Quasar 2 per phase. Additional rounds are available and quoted before they start. A revision means refinement of the agreed direction; a change of direction after approval is new work.

6. Ownership

On final payment, ownership of the delivered design and code for your project transfers to you. We keep ownership of our underlying tools, frameworks and reusable components, and grant you an unlimited licence to use them as part of your site. Third-party assets — fonts, stock imagery, plugins, hosting — remain under their own licences, which you are responsible for maintaining after handover.

Unless you ask us not to, we may show the work in our portfolio.

7. Third-party services

Sites we build rely on services we do not control, such as hosting, domains, analytics, email and booking tools. We will recommend and configure them, but we are not responsible for their outages, pricing changes or policy changes.

8. Warranty and support

We fix defects in our own work — where the site does not function as agreed — free of charge during the post-launch support window stated in your package. That window does not cover new features, third-party breakage, or changes made by others to the site after handover.

Beyond that, the website and our services are provided "as is". We do not guarantee specific search rankings, traffic, conversion rates or revenue, because those depend on factors outside a website's control.

9. Limitation of liability

To the extent the law allows, our total liability arising from a project is limited to the fees you paid us for that project, and we are not liable for indirect or consequential losses, including lost profits or lost data.

10. Cancellation

Either side may end a project in writing. You pay for work completed up to that date, and the initial deposit is non-refundable once work has begun. We will hand over what has been produced so far.

11. Governing law

These terms are governed by the laws of [jurisdiction to be confirmed], and disputes will be handled in its courts.

12. Contact
